Implanon Implants are an effective birth control device when properly installed. They are about the size of a match stick and are placed under the skin of your arm using an applicator.
Unfortunately, due to carelessness on the part of the healthcare provider (doctor, nurse, or medical assistant), sometimes they are not actually inserted. The healthcare provider should check to feel the implant under the skin. Failure to properly insert an implant or to carefully feel for the implant just under the skin after an attempted insertion is negligence.
The first notice that an Implanon implant was not actually inserted is often when the patient becomes aware they are pregnant.
California is one of the few states in the country that recognizes the right of an individual to bring a claim for negligence causing pregnancy. In such cases, the parent has a right to seek compensation for the cost of raising the child, pain and suffering, and other economic losses.
